Subsides religieux…Sewalaye et autres perdent leur procès contre la Mauritius Sanatan Dharma Temples Federation



Sewalaye et autres ont perdu leur procès contre The Mauritius Sanatan Dharma Temples Federation. Mécontents que la fédération ait octroyé une partie des subsides qu’elle reçoit du gouvernement pour être distribués aux membres à des kalimayes, baitkas et clubs, ils se sont retirés de la fédération et se sont joints au Shri Sanatan Mandir Parishad. Ils réclament un traitement égal et que leurs parts des subsides leur soit payés par le gouvernement à travers leur Parishad. Dans un jugement rendu, le 9 décembre dernier, le juge Asraf Caunhye estime que les plaignants n’ont pu établir que (1) they have lawfully elected to sever all ties with the defendant; (2) Government should be restrained from paying to the defendant the whole of the subsidy but should be ordered to remove therefrom that part of the subsidy which has been traditionally paid to the defendant in respect of the plaintiffs; (3) they are entitled to any declaration for the co-defendant to take measures to ensure that they     enjoy equality of treatment or their right to freedom of association.
