Le ministère du Travail v/s La Vanilla Crocodile Park Ltd
Une charge rejetée, une autre établie
Le ministère du Travail, des Relations Industrielles et de l’Emploi a poursuivi La Vanille Crocodile Park
sous deux charges, notamment (i) wilfully and unlawfully failed to securely fence the dangerous part of a
machinery et (ii) failing to make records available for inspection. La Vanille Crocodile Park Ltd a été
reconnu coupable sous la seconde charge, alors que la première charge a été rejetée. En effet, la
magistrate A. Ramdin a retenu le fait que, le jour où l’entreprise a été verbalisée, la machine à couper
des aliments pour animaux n’opérait pas en raison d’une faute technique. La magistrate Ramdin écrit:
“The Court is satisfied that the food processor did have a cover fitted with a device which would stop its
operation when the cover was lifted, however it is also on record that on that very day the machine was
not in use due to a faulty switch. Furthermore it is noteworthy that the machine was used to chop
vegetables for animals in large quantity and during the operation it had to be covered otherwise the
food would spill all over the place. Therefore it is clear that when in use the machine had to be covered
at all times so as to avoid spilling of food, hence it would be most unlikely that an operator would have
access or come into contact with the rotating blades.”
