Empiètement : La magistrate Wendy Rangan ordonne la démolition d’une construction illégale à Pamplemousses

Le couple Deoraz et Sudevi Sadasing a poursuivi ses voisins Harshanand Raj et Navindeo Beharee en Cour Intermédiaire. Il leur reprochait d’avoir construit un bâtiment en béton et un garage en tôle en ne respectant pas la distance réglementaire.

Dans sa plainte, le couple Sadasing a réclamé le “pulling down” de la construction illégale et des dommages de Rs500,000. La magistrate Wendy Rangan lui a donné gain de cause en ce qui concerne le “pulling down”, mais a rejeté la demande de dommages. Elle a ordonné aux Beharee de “pull down the part of the concrete building on the extent of 15.90sqm and the part of the garage on the extent of 2.40sqm that encroach on the plaintiffs’ property within four months of the date of the present judgment.”
