Empiètement…Govindarajen Naidoo Gungaloo poursuit son frère, Haree Krishna, mais sa plainte est rejetée
Govindarajen Naidoo Gungaloo a perdu son procès contre son frère, Haree Krishna. Les deux sont voisins. Govindarajen reprochait à son frère d’avoir empiété sur son terrain en construisant sa maison et un mur et il réclamait la démolition de la maison et du mur, ainsi que des dommages de Rs100,000. Dans sa plainte, Govindarajen Naidoo Gungaloo a précisé qu’il avait fait arpenter son terrain par M. Koheratty. Or, dans sa déposition en Cour, l’arpenteur Koheratty a admis que “ his survey exercise was not in conformity with Section 10 of the Land Surveyors Act inasmuch as the title deeds of the adjoining owners did not emanate from them prior to his survey in line with his memoranda of survey viz. Docs. E&H and that he did not base himself on a proper title deed of Plaintiff for the purposes of his survey in the first place in order to be further in accordance with Section 9 of the Act, let alone that Defendant was not notified by way of a mise-en-demeure to pull down his said wall being in line with the version of Defendant that his said wall did not encroach onto the land of Plaintiff supported by his surveyor’s report.” Par consequent, la magistrate Rangan a rejeté la plainte.
