La magistrate Sheila Bonomally prononce un « non-suit »…

La magistrate Sheila Bonomally a « non-suit » la plainte de Kevin Heymankesh Dukhira, un habitant d’Ebène qui réclamait la démolition du sanctuaire en béton de son voisin, Sanjay Luckoo.  Dukhira réclamait aussi la modification d’un portique érigé par Luckoo et des dommages d’une valeur de Rs 500,000 pour le « continuous trouble and annoyance caused to him ». Après l’analyse des faits, la magistrate Bonomally est arrivée à la conclusion que la plainte de Dukhira « discloses no complete cause of action » et que les « proceedings » sont «  a mere nullity ». Les propos de la magistrate sont comme suit : ‘’I take the view in the furtherance of the proper administration of justice that given that there is no complete cause of action in the first place disclosed by the averments of the plaint as it has not been averred that they were based on the survey of a sworn Land Surveyor, it would be futile to pursue any further with the proceedings which are a mere nullity.’’
