Establishment of facts re: Repatriation of ex-CEO of the MIoD
(Ebène, Mauritius) – The board of MIoD has noted the reporting of some information relative to the repatriation of the ex-CEO of MIoD. The MIoD wishes to point out some facts as outlined below.
As you will notice the MIOD has, at all times, honoured its contractual commitments towards Mr Fernandez Zara. It is highly regrettable that an ex-CEO resorts to false information to discredit the institution.
- On 12th October 2017, counsel for the MIoD requested the counsel of Mr Fernandez Zara to communicate to the MIoD a quote for repatriation costs and air tickets for Mr Zara so as to determine the reasonable amount payable on this count
- On 27th October 2017, counsel of MIoD reminded Mr Zara’s counsel of our prior request for quotes and specifically stated the MIoD is anxious as Mr Fernandez Zara may turn around and say that the MIOD is delaying on the payments that are contractually due.
- On 31st October 2017, again MIoD’s counsel requested Mr Fernandez Zara counsel to submit to the MIoD quotes for repatriation expenses including air tickets for Mr Zara and his family.
- By letter of 6th November 2017, the counsel of Mr Fernandez Zara stated that his client will be leaving Mauritius “in due course” and requested us to refund for air tickets and repatriation expenses as set out in Praecipe dated 27th September (claim made in case lodged in court for his dismissal from the MIoD).
- On the 21st November, MIoD’s counsel informed Mr Zara’s counsel that the stand of the MIoD has not changed and further reiterated our previous requests for submission of quote for repatriation expenses, including Air tickets.
- Following an Article that appeared in the local press on 4th December 2017 regarding his repatriation, MIoD’s counsel wrote to Mr Zara’s counsel to inform the latter that the information relayed to the press made abstraction of our exchanges as per items 1-5 above. Once more we reiterated that the MIoD will pay reasonable repatriation expenses but since the amount is quite significant, this could not be paid on the mere asking but needs to be supported by quote which has been requested since nearly two months. We once more requested for quotes to be submitted.
- We finally received quote for repatriation expenses and air tickets on Friday 22nd December 2017 in the afternoon.
- As the following week was a short week with only two working days for most companies of the private sector and most companies would resume work on the 8th January 2018, we could only proceed with request for alternative quotes only from 8th January 2018 onwards. This could not be done before as we did not have any information on the type of container that would be required to ship back his belongings and to which address this had to be done. We received alternative quotes on Friday 19th January 2018 as in between there were cyclone Berguitta where companies were not working on 17th and 18th January 2018. It should be noted that Tuesday on 16th January 2018, the country was on alert 2 as cyclone was approaching and priority was to get ready to face the cyclone.
- The Board of the MIoD met on Friday 19th January 2018 and took a decision on this issue.
- MIoD’s counsel submitted a proposal to close this issue to Mr Zara’s counsel on Monday 22th January 2018. Unfortunately, this proposal was not retained.
- Meanwhile the MIoD has negotiated with Mr Zara’s chosen service provider for the repatriation of his belonging and to get a quote that is closely aligned with market rates while keeping the same services and benefits as the quote submitted on the 22nd December 2018 by Mr Zara’s counsel.
- On Tuesday 23rd January 2018, MIoDs counsel wrote to Mr Zara’s counsel to inform the latter that the MIoD will use Mr Zara’s chosen service provider for the repatriation of his personal belongings as per point 11 above. We also requested him to submit to the MIoD the invoices for his air tickets so that we may refund same.
