e Dr Fazlur Rehman Jaufeerally perd son procès contre l’Etat
Le Dr Fazlur Rehman Jaufeerally, employé comme Specialist/Senior Specialist au ministère de la Santé et de la Qualité de la Vie, a été débouté avec dépens dans le procès qu’il a intenté à l’Etat. Il réclamait des dommages de Rs5 millions à l’Etat pour avoir déclaré son poste vacant ou pour abus de droit. Le Dr jaufeerally avait pris un congé de trois semaines pour se rendre à Singapour. Puis, il décida de prolonger son congé de deux ans. Ce congé ne fut pas approuvé par le ministère de tutelle et il y eut un échange de correspondence. Finalement, le Dr jaufeerally informa le ministère de la Santé qu’il allait rentrer au pays “to sort once for all the queries”. Malgré tout, son poste fut déclaré vacant. Expliquant sa decision de rejeter la plainte, la juge Nirmala Devat a eu ceci à dire: “Having failed to avail himself of the several opportunities given to him to resume duty between June 1999 and October 2004, the defendant cannot be held liable in damages for having on 22 June 2005 declared plaintiff’s post of Specialist/Senior Specialist vacant, after a rather long wait of nearly 6 years for the plaintiff who had shown no interest in resuming his post. As rightly submitted by learned Counsel for the defendant, the plaintiff cannot have the best of both worlds, that is, working in Singapore and at the same time trying at all costs and by all means to secure his job in Mauritius. If anyone is to be criticized and be held responsible for any prejudice or damages the plaintiff might have suffered, it is none other than the plaintiff himself for having obstinately refused to resume his post and for having stayed in Singapore to pursue his goals and plans and to fulfil his desires and wishes to the detriment of his job in Mauritius. »
