Accident mortel à Plaine Verte : Nanak Imran Toona reconnu coupable d’homicide involontaire par imprudence



Accusé d’homicide involontaire par imprudence, Nanak Imran Toona a été reconnu coupable par la magistrate D. Gayan. La police lui reprochait d’avoir causé la mort Dunraj Persand alors qu’il était au volant d’un omnibus. L’accident mortel se produisit à la rue Edgar Laurent, Plaine Verte. En Cour, Nanak Imran Toona plaida non-coupable et choisit de ne pas venir à la barre des témoins afin de ne pas s’exposer à un interrogatoire contradictoire.

Estimant que la poursuite a établi un “strong and unshaken case”, la magistrate Gayan a conclu que les preuves apportées par la poursuite “remain Unrebutted”. “This Court has repeatedly stressed that the unsworn statement of an accused is only evidence of what he told the Police. Where the evidence for the prosecution establishes a strong and unshaken prima facie case and the accused chooses not to swear to his statement and expose himself to cross-examination, the trial Court is perfectly entitled to conclude that the prosecution evidence remains unrebutted. It is of course true that the burden of proving the guilt of an accused squarely lies on the prosecution and that the accused is entitled to remain silent. His right to silence, however, is exercised at his risk and peril when, at the close of the case for the prosecution, a prima facie case has been clearly established since the burden then shifts on him to satisfy the Court that it should not act on the evidence adduced by the prosecution. ». Pour la magistrate Gayan, la poursuite a établi la culpabilité de l’accusé « beyond reasonable doubt ».
