Paris: Sport Data Feed Ltd perd son procès contre Silver Sports Ltd
« I find that the plaintiff has failed to show to my satisfaction that it is an exclusive licensee of FDC in relation to the IP rights that subsist in the said ‘Fixture Lists’ and ‘Football Data’ and that the defendant has been in breach of such IP rights. » Etant parvenu à cette conclusion, le juge Gérard Angoh, siégeant à la division commerciale de la Cour Suprême, a rejeté la plainte de Sport Data Feed Ltd contre Silver Sports Ltd avec dépens.
Sports Data Feed Ltd recherché, entre autres, ce qui suit : “A perpetual order in the nature of an injunction, restraining and prohibiting the defendant by itself and through its servants, ‘préposés’, agents or otherwise from infringing or further infringing the applicant’s interest and legal rights in the copyright in ‘the ‘Fixture Lists’ and ‘Football Data’ as the exclusive licensee of Football DataCo Limited for the supply and sub-licence of the ‘Fixture Lists’ and ‘Football Data’ for the use and reproduction in connection with betting (including use and reproduction by fixed odds bookmakers excluding pool betting) in Mauritius whether by reproducing, making use thereof on coupons or on any other infringing material or by electronic digital means, or otherwise unlawfully dealing with ‘the Fixture Lists’ and ‘Football Data’ of the Football Association Premier League Limited, the Football League Limited, the Scottish Professional Football League Limited and/or part thereof.”
