Le Domaines des Alizées Ltée doit-elle la somme de Rs 19,235,310.98 à Rey & Lenferna Ltd ?  Après avoir pris connaissance des faits, la juge Rehanna Mungly Gulbul trouve que « there exists arguably a genuine and substantial dispute as to whether the applicant is indebted to the respondent in the sum averred in the statutory demand ».  Par conséquent, puisqu’il n’a pas encore établi que Le Domaine des Alizées Ltd doit la somme précitée à Rey & Lenferna Ltd, la juge a refusé de valider la « Statutory Demand » de cette dernière.  Il est à souligner que “The statutory demand pertained to the payment of a debt allegedly due by the applicant to the respondent in the sum of Rs 19,235,310.98.  This sum is alleged to represent the amount due for the works carried out by the respondent as a sub-contractor nominated by the main contractor, Building & Civil Engineering Co Ltd (BCE), in connection with the construction of a project for the applicant (the client) and known as ‘Le Domaine des Alizées’ ( The project).”
