Condamné à une amende de Rs 2,000 : Pajanilingum Renghen gagne son appel en raison d’un acte d’accusation défectueux…
Poursuivi en Cour de district de Grand-Port sous une accusation d’avoir proféré des menaces à l’encontre de quelqu’un venu le voir avec l’intention de louer son bâtiment, Pajanilingum Renghen a été reconnu coupable et a été condamné à payer une amende de Rs 2,000. Il a interjeté appel et a réussi à faire casser le jugement de la Cour de district de Grand-Port et à faire annuler l’amende. Pajanilingum Renghen a basé son appel sur le point suivant: “The information does not disclose an offense known to law”.
Les juges Benjamin Marie Joseph et Renuka Dabee lui ont donné gain de cause. Pour eux, “the information is defective for failing to disclose an order or condition in relation to the verbal threat complained of and it is a defect which goes to the root of the charge”.
