La “winding up petition” est rejetée avec dépens
La “winding up petition” logée contre Apavou Immobilier Ltd par Morgan Philips Middle East & Africa SAS a été rejetée avec dépens. En effet, la juge P. D. R. Goordyal-Chittoo a retenu l’objection d’Apavou Immobilier Ltd à l’effet que le “supporting affidavit“, daté du 4 février 2021, “is invalid, of no probative value and cannot be relied upon in support of the petition“. Selon Apavou Ltd, relativement à cet affidavit, il n’est pas apparent que l’avoué du pétitionnaire détenait une procuration, qui avait été déposée chez un notaire à Maurice. Par conséquent, la juge considère que “the Statutory Demand is for all intents and purposes inadmissible in the circumstances“.
