Cour Suprême…l’appel de Jean-Marie Celestin rejeté

Jean-Marie Celestin avait été arrêté et condamné à 16 ans de prison et à une amende de Rs.100,000 pour possession à des fins de distribution de 94.3 grammes d’héroïne. Il avait fait appel contre cette sentence qui selon lui été trop sévère et excessive.

Cet ancien mécanicien avait été jugé coupable de trafic de drogue. Il avait 94,3 grammes d’héroïne, le 20 novembre de 2019, sur le parking de  Savemart, à Nouvelle France. Il voulait vendre ce colis à un officier de l’ADSU qui avait préalablement pris contact avec lui.  La valeur de la drogue est estimée à Rs 1,4 million.

Le verdict avait été prononcé par le juge Luchmyparsad Aujayeb.

Dans un jugement rendu le lundi 17 février dernier, la Cour Suprême a rejeté son appel en arguant qu’elle n’a trouvé aucun élément dans les ‘submissions’ de l’avocat Sanjeev Teeluckdharry qui représentait Jean-Marie Celestin pouvant faire peser la balance de la justice en faveur d’une révision de la peine infligée initialement.

«The record reveals that defence counsel was given all latitude to cross-examine the witnesses and put the questions he deemed necessary. In the circumstances we consider that the submission that the trial Judge failed “to hear enough evidence” before sentencing is totally unfounded and is in the circumstances vexatious and frivolous. Furthermore, Mr. Teeluckdharry did not indicate to us what additional evidence, if any, that the learned Judge ought to have heard prior to sentencing. Nor do we find any merit in the submission that the learned Judge has failed to adequately assess the  background  circumstances  of  the incident. A  perusal  of  the judgment  reveals  that  the trial Judge  had  thoroughly set  out and considered  all  the evidence adduced, including the circumstances in which the drug sale was effected. We further do not find any merit whatsoever in the submission that the trial Judge failed to adequately consider the mitigating factors and circumstances. Indeed, a perusal of the judgment reveals the contrary” ont écrit les juges Rehana Gulbul, Veronique Kwok et Denis Mootoo dans leur jugement.
