Les héritiers de feu Ramalinga Chetty perdent leur procès contre la State Bank

Les héritiers de feu Ramalinga Chetty ont perdu leur procès contre la State Bank of Mauritius Ltd à laquelle ils réclamaient des dommages de Rs 5 millions pour fraude alléguée. Ramalinga Chetty était un client de la SBM et selon eux, il y a eu certaines transactions qui ont été effectuées à l’insu de leur défunt père. La SBM a nié et a insisté que ces transactions ont été effectuées sur instructions verbales et écrites. Le juge a rejeté la plainte avec les commentaires suivants:  “On the facts and having regard that the basis of the relationship between a bank and its customer has to be trust rather than distrust, there was nothing in the history of the transactions of Mr Chetty with the defendant bank that should have put the defendant on inquiry as to the genuineness of Mr Chetty’s signature and the honesty behind the Instructions. The evidence clearly shows that at all material times, the signature, on the instructions which were duly verified by the officers of the defendant bank, who are not handwriting experts, was the signature of Mr Chetty and it is evident that the defendant took all reasonable measures to ascertain the identity of Mr Chetty’s signature with the specimen provided initially before executing the transactions.” Du fait que le jugement totalise 8,692 mots, nous avons décidé de le publier en deux parties aujourd’hui, le samedi 5 mai et le lundi 7 mai.
